Henry initially supported Richard III, but later rebelled and was beheaded with no arraignment or legal proceeding.

Given the fact that the 2nd Duke's son, the 3rd Duke, was accused of treason by Henry VIII 38 years after the 2nd Duke was beheaded for treason, Shakespeare could not resist an ironic embellishment to his play Henry VIII that points this out. The 3rd Duke's accuser says: " 'If' quoth he [referring to the 3rd duke] 'I for this had been committed- As to the Tower I thought-I would have play'd The part my father meant to act upon Th' usurper Richard; who, being at Salisbury, Made suit to come in's presence, which if granted, As he made semblance of his duty, would Have put his knife into him.'..." Henry VIII Act 1, scene 2

After Buckingham's son, the 3rd Duke, is accused of treason, Shakespeare can't resist another reference to the 2nd Duke's execution. In his farewell speech, the 3rd Duke says: "My noble father, Henry of Buckingham, Who first rais'd head against usurping Richard, Flying for succour to his servant Banister, Being distress'd, was by that wretch betray'd And without trial fell; God's peace be with him!..."
