State of Georgia Franklin County } This indenture made & Entered in to this the Seventeenth day of May A D one thousand eight teen hundred & fifty five between William Pool of the State & County aforesaid of the one part & Elisha M Pool of the Same place Witnesseth that The Said William Pool for the natural affection & Love I have for My Son Elisha M Pool I do deed him to give unto Elisha M Pool a Sertin parcel of land on the waters of Nailes Creek containing one hundred & twenty acres Moore or less buting & bounding as follows beginning at one Ironwood corner on the East bank of Said Creek thence up Said Creed to the Mouth of John Strange his Spring & branch then up Said branch to the ford above the Spring to a hollow thence with Said hollow to Gillespies old line thence N 16 Ω w 18 No thence E 21 to a pine Stump thence 47 E 38 to a chestnut S 47 W 1150 to pine N 81 W 26 50 to the bigining corner on the East bank of the Said creek. I the Said William Pool do warrant & do forever defend the land aforesaid unto the Said Elisha M Pool his heirs & assigns & against the claim of all other persons what ever claiming the Same or any part there of for which I do Give Grant & defend to Elisha to him at three hundred & fifty Dollars to be charged to him in My estate towards his part till the rest of the heirs is Made Equal with him in testimony whereof I have hereunto Set my hand & Seal the day & year above written in the presence of us}

Will of William Poole 02 Dec 1846 Franklin County, Georgia
In the name of God Amen - I William Poole of the State and County aforesaid calling to mind the mortality of man, and knowing that it is appointed for all men once to die, and now being of sound and disposing mind, I do hereby make, ordain and constitute this my last will and testament, hereby revoking all former wills made by me,
Principly and first of all I give and commend my soul to Almighty God who Gave it; And my Body to the Earth in a decent and Christian burial, nothing doubting but at the General Resurection, I shall receive the same again by the Mighty Power of God and as touching such worldly Estate as it has pleased God to bless me with, I do hereby dispose of the same in the following manner;
1st I wish the payment of all my just debts;
2nd I give and bequeath to my beloved wife Kiziah all my Estate both Real and personal during her natural life or widowhood, accept such property as is hereafter disposed of, and at or after her death or marriage to be divided between my children and grand children namely Sarah O Kellys children, James S., Benjamin B., Elizabeth Andersons children, Zillah, John H, George W, William J, Mary Ann, Nancy C, Elijah C, Elisha M. Peter S, and Eliza I Poole deducting from each share the several amounts before received which will appear by reference to a book of distribution kept by myself of amounts advanced by me to and for my children a charged deducting from the children of Sarah OKelly and Elizabeth Anderson the several sums previously advanced to the said Sarah and Elizabeth,
3rd I give and bequeath to my soninlaw George W Conally and his wife Martha the tract of land they now live on containing sixty acres more or less, this together with what they have before received, this is to be their full portion of my Estate, reserving to myself the title of said tract of land until a full settlement of my estate, allowing the said Conally the use and benefit of the land until a final settlement of my estate then the title to vest in the said Conally and his heirs,
4th It is my desire that my children as they come of age or marry that they receive such property as my older children has received, at a fair Valuation, and if at any time from the Increase of property it should become too expensive to the estate, I leave it discretionary with my Executors to make such distribution as may seem best for the Intrest of the Estate, by division or sale,
5th I give and bequeath to my son Benjamin B. Poole all that tract or parcel of land whereon he now lives containing one hundred and sixty acres more or less, Granted to Joel Mabry, Bouned as follows, beginning at a red oak corner, thence N 34 W 17 chs to a pine corner, thence S 65, W, 20 chs, to a post oak corner, thence N. 55 W 26 chs, to a Chesnut Corner, thence S. 55, W opposite the S.W. corner of a tract of land Granted to A Sexton, thence along the westward and northard line to the south end of the first mentioned line, thence along said line to the beginning corner, at the sum of one hundred and fifty dollars, which is to be deducted from his part in a final settlement reserving to myself and estate the title of said land until a final settlement of my estate, then the right and title to vest in the said Benjamin B. Poole his heirs and assigns, still allowing the said Benjamin B. and family the use and benefit of said land until said settlement,
6th I also give and bequeath to my son George W Poole the tract or parcel of land whereon he now lives, containing Ninety Eight acres, more or less, bounded as follows, beginning at a black oak corner on the old original line of the land I now live on, thence S. E. a conditional line to a Post oak corner thence S. W. a Hickry Corner, thence South E. to the original line to a White oak corner, thence the original to the beginning corner as apart of his legacy, at the sum of one hundred and fifty dollars,
7th And lastly I do hereby constitute and appoint my beloved wife Kiziah Poole and my son George W Poole my Executors to this my last will and testament, In witness whereof I have hereunto set my hand and seal this second day of December 1846
